1. Acceptance of Terms

Welcome to 12th Pass ("the Platform").

By accessing or using 12th Pass via our website or any of our related services, you ("User," "you") agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional policies we may introduce.

If you do not agree, you must discontinue use immediately. Your continued use of the Platform constitutes acceptance of any modifications to these terms.

2. Service Description

12th Pass provides access to AI-powered educational services specifically designed for IIT JEE examination preparation, including but not limited to:

  • AI chatbot for doubt resolution and concept clarification
  • Past year paper analysis and practice question databases
  • Personalized study recommendations and learning path optimization
  • Performance tracking, analytics, and progress monitoring
  • Image-based question solving and formula recognition

12th Pass is available through a Free plan and a paid Pro plan, which differ in the features they include. Detailed subscription information is provided in Section 5 (Subscription Plans and Payment Terms).

3. Account Registration and Security

To access 12th Pass, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept full responsibility for all activities conducted under your account
  • Ensure you are at least 13 years of age, or have obtained parental consent if younger

4. Acceptable Use Policy

By using 12th Pass, you agree to comply with all applicable laws, regulations, and these Terms. You expressly agree not to:

Account & Access

  • Share, transfer, sell, or disclose your 12th Pass account credentials to any third party, including other students, coaching centers, or educators.
  • Access or attempt to access another user's account, data, exam history, or analytics.

Platform Integrity

  • Attempt to gain unauthorized access to any part of the 12th Pass platform, including our AI systems, knowledge base, exam engine, administrative tools, or backend infrastructure.
  • Reverse engineer, decompile, copy, or attempt to extract source code, models, datasets, or proprietary exam-processing logic.
  • Scrape, harvest, or programmatically extract questions, explanations, solutions, or exam content from 12th Pass without explicit written authorization.

Security & Technical Misuse

  • Upload, transmit, or distribute viruses, malware, bots, scripts, or any harmful or automated code intended to disrupt or manipulate the platform.
  • Interfere with or disrupt the performance, security, or availability of 12th Pass or related systems.

Intellectual Property & Content Use

Reproduce, republish, distribute, or commercially exploit 12th Pass's proprietary content, including:

  • AI-generated explanations or solutions
  • Curated or enhanced IIT-JEE past paper content
  • Our exam-mode questions, answers, analytics, or reports
  • Upload or share content that infringes intellectual property rights of 12th Pass, exam boards, or any third party.

Academic Integrity

  • Use 12th Pass to cheat on any examination, assessment, school test, or competitive exam.
  • Use exam-mode, timed papers, or AI-generated explanations for real-time cheating during live or remote-proctored exams.
  • Misrepresent your performance, manipulate answer submissions, or misuse AI feedback to gain unfair academic advantage.

Misuse of AI & Communication Tools

  • Generate or request harmful, abusive, or misleading content using 12th Pass AI features.
  • Harass, threaten, or abuse other users, support personnel, or educators.
  • Use 12th Pass to disseminate misinformation, spam, promotional content, or unauthorized advertisements.

Prohibited Commercial Use

  • Use 12th Pass services to build or train competing AI models, educational platforms, or exam-prep tools.
  • Use the platform for coaching-center operations, shared classroom use, or bulk student servicing without a commercial license or explicit permission.

5. Subscription Plans and Payment Terms

Subscription Plans

12th Pass offers a free plan and a paid Pro plan, available on monthly or annual billing. The features and usage limits included in each plan are described on our pricing page and may be updated from time to time.

Payment Terms

All payment processing is conducted through Razorpay, our third-party payment processor. By subscribing, you agree to the following:

  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You authorize us to charge your payment method at the beginning of each billing cycle
  • Subscription fees are subject to change with advance notice to subscribers
  • All fees are non-refundable except as required by applicable law
  • You are responsible for all applicable taxes associated with your subscription

6. AI-Generated Content and Limitations

12th Pass utilizes artificial intelligence technologies to generate educational content and responses. You acknowledge and agree that AI-generated content may contain:

  • Inaccuracies, errors, or incomplete information
  • Misinterpretations of complex or ambiguous queries
  • Outdated information that does not reflect current knowledge
  • Computational or mathematical errors

Important Notice: AI-generated content should be used as a supplementary study tool only. You are solely responsible for verifying the accuracy of all information, particularly before examinations. We strongly recommend cross-referencing AI responses with authoritative educational resources, textbooks, and qualified educators.

7. User-Generated Content

When using 12th Pass, you may submit questions, upload images, or create study materials ("User Content"). Regarding your User Content:

  • You retain all ownership rights to your User Content
  • You grant us a license to use your interactions for service improvement and AI model optimization
  • We will not share your personal study data with third parties without your consent, except as required by law or as described in our Privacy Policy
  • You represent that your User Content does not infringe upon any third-party rights or contain confidential information
  • You agree not to upload content that violates copyright laws or contains sensitive personal information

8. Intellectual Property Rights

All content, features, and functionality of 12th Pass, including but not limited to question databases, explanations, software, user interface design, graphics, and AI models, are owned by 12th Pass or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use 12th Pass for personal educational purposes only. You may not:

  • Reproduce, distribute, or create derivative works from our content
  • Use 12th Pass or its content for any commercial purpose
  • Develop a competing service using our content or methodologies
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices

9. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF 12TH PASS, INCLUDING ITS AI-POWERED FEATURES, EXAM-MODE, CONTENT, AND ANY SERVICES PROVIDED, IS AT YOUR SOLE RISK. 12TH PASS IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, 12TH PASS DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

12th Pass does not warrant or guarantee that:

  • The platform, including AI-generated responses, explanations, or exam-mode features, will be accurate, reliable, or error-free.
  • 12th Pass will be uninterrupted, timely, secure, free from vulnerabilities, free of harmful components, or compatible with all devices or networks.
  • Any content, including solutions, citations, or explanations, will be complete, pedagogically appropriate, or aligned with any specific syllabus or exam pattern.
  • Any errors, bugs, or defects in the platform will be corrected, whether reported or not.
  • The platform will meet your specific performance expectations, study goals, or examination preparation needs.
  • Use of the platform will result in improved academic performance, exam success, or specific scores in IIT JEE or any other assessment.

You acknowledge that AI-generated content may be inaccurate or incomplete, and you are solely responsible for independently verifying any information before relying on it.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 12TH PASS, ITS PARENT ENTITIES, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, goodwill, data, or business opportunities
  • Personal or academic losses, including examination results, rank impacts, or scholarship outcomes
  • Service interruptions, delays, or inability to access the platform
  • Errors, omissions, inaccuracies, or reliance placed on any AI-generated content
  • Unauthorized access, hacking, or alteration of your account, submissions, or data
  • Any conduct or content of third parties, including other users or external service providers

These limitations apply regardless of the theory of liability-contract, tort, negligence, strict liability, or otherwise-and even if 12th Pass has been advised of the possibility of such damages.

To the extent permitted by law, our total aggregate liability for all claims arising from or relating to the use of 12th Pass shall not exceed the greater of:

  • The total amount you paid to 12th Pass in the twelve (12) months preceding the claim, or
  • One hundred Indian rupees (₹100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

We reserve the right to suspend or terminate your account and access to 12th Pass immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms and Conditions
  • Violation of applicable laws or regulations
  • Fraudulent, abusive, or harmful conduct
  • Extended periods of account inactivity
  • At our sole discretion for any other reason

You may terminate your account at any time through your account settings. Upon termination, your right to use 12th Pass will immediately cease, and you will forfeit access to your study history, analytics, and any remaining subscription benefits. Paid subscription fees are non-refundable upon termination.

12. Modifications to Terms

We reserve the right to modify or replace these Terms and Conditions at any time at our sole discretion. Material changes will be notified to users through email notification or prominent notice on 12th Pass at least thirty (30) days prior to the effective date of such changes.

Your continued use of 12th Pass following the posting of revised terms constitutes your acceptance of such changes. If you do not agree to the modified terms, you must discontinue use of 12th Pass.

13. Privacy Policy

Your use of 12th Pass is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using 12th Pass, you consent to the collection and use of information as detailed in our Privacy Policy. We encourage you to review the Privacy Policy carefully.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these terms or 12th Pass shall be subject to the exclusive jurisdiction of the courts located in India.
